Contest Rules

1. General Description of Contest (Contest Description):
The Contest is held in the framework of popularization of Skyforge game (hereinafter referred to as the “Game”) and its distributor My.com B.V. Another socially useful purpose of the Contest is to unite the Game community and to discover creative skills of the Contest Participant.

The Contest Organizer (hereinafter referred to as the “Organizer”):

2. Definitions Used in the Rules:
Participant means any capable individual aged 16 and older registered and having an account in the Game, involved in the gameplay at least 10 minutes during the Contest period, member of one of the Teams by the end of the Contest, citizen of the United States of America, Canada, Australia, Greenland and other states which are located in Northern America (hereinafter “Northern America”) and citizen of Germany, France, the Netherlands and other states located in Europe.

Team (Pantheon) means a team of Participants formed by the Team Creator, subject to paying fifty thousand (50,000) credits (in game currency) and adding at least two more Team members from among the Participants within seven (7) calendar days from the moment of paying credits. A Team can be formed throughout the Contest period. By the end of the Contest, the Team shall not be disbanded.

Commander means Team Participant appointed by the pantheon Creator or chosen by voting of other pantheon members. If, during the Contest period, the Team consists of less than 3 Commanders, they are appointed automatically.

Winner means the Team which has the top score of game “Points for Space Program Development” among all other Teams by the end of the Contest.

Prize Takers means Teams whose score of game “Points for Space Program Development” comes second and third after the Winner by the end of the Contest.

“Points for Space Program Development” means game points earned during confrontation of pantheons in the following ways:
• Participation in gaming activities on the territories belonging to the pantheon or hostile pantheons;
• Development of space program infrastructure - any pantheon Member brings “points for infrastructure development” to the pantheon taking part in adventures as part of a group of players of the same pantheon. Using “points for infrastructure development”, pantheon commanders may buy infrastructure elements which either bring “points for space program development” directly, or increase their earning from other sources;
• Winning in PvP (players vs. players) part of pantheon battles;
• Defeating rare and powerful enemies (avatar intrusion) as part of the pantheon.

Prizes means prizes for Prize Takers and the Winner defined in section 6 hereof.

Contest Rules include these Contest Rules and other information about the Contest placed on the Website.

3. The Contest Dates:
The total Contest period: starting from 04:00 (hereinafter, by Pacific Standard USA time) on December 2, 2015 until 23:59 on March 23, 2016 (inclusively). The period during which a Team may participate in the Contest: from 4:00 on December 2, 2015 until 23:59 on March 23, 2016 (inclusively).

The period of the Prize Fund creation: from 4:00 on December 2 until 23:59 on March 23, 2016 (inclusively).

The deadline for determining the Winner and Prize Takers: from 00:00 on 23 March, 2016 until 23:59 2016 on 23 April, 2016.

4. Method and Procedure of Informing the Contest Participants about the Contest Terms and Conditions:
The Contest Participants and potential Contest participants will be informed about conditions of participation through the following sources: the Website and the Rules.

In case of extension of the Contest period, increase of the Prize Fund or other changes, the Organizer will publish additional changes and new rules on the Website.

In case of early termination of the Contest, the Organizer will publish the relevant announcement on the Website.

5. Method of Forming the Contest Prize Fund:
The Competition prize fund is formed at the expense of the Organizer.

Mechanics of formation of the prize fund size:
- At the start of the Contest, the prize fund size equals to $15,000 USD total combined for North America and Europe, to be split evenly to award the separate winners for each of the two regions.

  • The prize fund increases during the Contest period by the amount of “Special Contribution” Kits purchased by Players. A “Special Contribution” Kit includes:
    • An in-game item - a cap with the Contest logo;
    • An in-game item - a T-shirt with the Contest logo;
    • A title on the in-game portal;
    • 2,500 Spark Replicators, 1,000 tactical intuition replicators, 10 variatrons.

The cost of the “Special Contribution” Kit is one dollar and ninety-nine cents USD ($1.99) for North America and one Euro and seventy-nine eurocents (€1.79) for Europe.

The size of the prize fund is displayed interactively on the Website and is replenished automatically for the amount of each purchased Specific Fan Kit. The sum of described prize fund less the amount of taxes to be withholded due by Organizer forms the basis for prizes to be paid to Winner and Prize Takers (hereinafter - “Prize Fund”).

6. The Procedure for Determining Prizes.
Information on the number and description of the Contest prizes is given below:

2 The Prize Taker Thirty (30) percent of the amount of the Prize Fund formed by the Contest end date. The prize is expressed in cash in USD or Euros. The prize is awarded to the Team. Additional prizes in the form of additional in-game functionalities provided by the Game. Such additional prizes are awarded to each Team Member of the Prize Taker. Specific characteristics of additional prizes will be determined by the Organizer later and placed on the Website.
3 The Prize Taker Twenty (20) percent of the amount of the Prize Fund formed by the Contest end date. The prize is expressed in cash in USD or Euros. The prize is awarded to the Team. Additional prizes in the form of additional in-game functionalities provided by the Game. Such additional prizes are awarded to each Team Member of the Prize Taker. Specific characteristics of additional prizes will be determined by the Organizer later and placed on the Website.

The Contest Organizer withholds the corresponding tax from the amount of paid Prizes in accordance with the procedure established by the laws of the Netherlands.

The sum of the Prize is split in equal proportions between Commanders of the Winner and the Prize Takers’ Teams.

7. The Procedure of Giving Out Prizes.
Prizes based on the results of the Contest will be transferred in accordance with bank account details of Commanders of the Winner’s and the Prize Takers’ Teams who provided data about themselves in accordance with this section within thirty (30) calendar days from the date of summarizing the Contest results. In case if one or more Commanders do not provide the data necessary to transfer the main Prize within the prescribed period, the size of the main prize will be redistributed among the Commanders of the relevant Team who provided the data.

Prizes to the Contest Winners in form of cash in USD for Commanders from North America or Euro for Commanders from Europe will be provided within thirty (30) calendar days from the date of expiry of the term for data providing by Commanders by bank transfer to the Commander’s account. The Contest Organizer is considered to have fulfilled his obligation on payment of the prize from the moment of receipt of funds to the Commander’s correspondent bank account. The Contest Organizer shall not be liable for non-delivery of the prize due to reasons beyond the Organizer’s control, including due to specifying by the Commander of inaccurate, incomplete or outdated information at registration for the Contest, providing additional information or in any other way.

Transfer of the right to receive a Prize to another person and the requirement about payment of cash equivalent of non-monetary Prizes is not allowed.

The Contest Rules do not provide for storage of unclaimed Prizes or their distribution upon expiry of the terms provided for Prize distribution.
To receive the Prize, the Commander shall perform the following steps:
- Provide to the Organizer’s authorized representatives a written statement signed by the Commander with data of his passport or another document proving his identity, his bank details for the sum of Prize transferring, other information and copies of other documents on request of the Organizer. This written statement and copies of documents shall be sent by e-mail in response to notification email about the prize winning within thirty (30) calendar days from the date of determining the Contest Winner and the Prize Takers subject to further sending the original of written statement within 5 (five) days.

The Contest is held on the Website in the Internet.

8. Method of Entering into an Agreement between the Contest Organizer and Participant:
The Agreement between the Contest Organizer and Participant is entered into as follows:

The Agreement is concluded by sending a public offer (proposal) by the Contest Organizer through placing information on the official website of the Contest: https://sf.my.com/, or acceptance of the offer (acceptance) by the consumer by fulfilling the conditions for recognition as the Contest Participant.

Since completion of these steps by the Participant, the Agreement between the Participant and the Contest Organizer is considered to be concluded.

9. The Procedure of Prize Awarding
The Contest results are final and are not subject to revision, except in cases of detection by the Organizer after announcement of such results of violations by the Winner or the Prize Takers of these Rules of Participation in the Contest taken place in the course of the Contest.

If the Organizer detects violations of these Rules or other conditions of participation in the Contest, or the Game rules, or the license agreement by the Winner and the Prize Takers, the victory of such participant will be cancelled by the Organizer.

The Contest Winner and the Prize Takers are informed about the victory by an announcement - information about the Winner and the Prize Takers will be published on the Website in the period from March 23, 2016 until April 7, 2016, and (or) by sending the relevant notification to the Winner’s email address and (or) in a different way.

10. The Participant’s Rights:
To get acquainted with the Contest Rules and other information about the Contest placed on the Website.

The Participant is entitled to participate in the Contest in accordance with the procedure specified hereby.

The Commander is entitled, in case of fulfillment of all Contest conditions and recognition of his Team as the Winner or the Prize Taker, to require from the Organizer to provide him with the Prize.

To receive information about changes in the Contest Rules.

11. The Participant’s Liabilities:
To perform actions specified herein.

In case if the Commander is declared to be the Prize Taker, the Participant must perform actions specified in clause 7 hereof.

To provide the Organizer with the rights to use his image, personal data, photo, interview or other materials about him related to his participation in the Contest for the purposes of the Contest and distribution of Prizes.

12. The Organizer’s Rights:
The Organizer is entitled to refuse in giving out the Prize to the Winner or the Prize Taker who failed to meet the requirements of the Rules, or the Winner and the Prize Taker who do not comply with the requirements hereof.

The Organizer reserves the right to change the Rules or cancel the Contest, provided that the Participants will be notified about the change of the Rules or cancellation of the Contest in the manner specified in clause 4 hereof.

The Organizer is entitled to exclude the Participant and the Team from participation in the Contest at any stage of the Contest if it suspects that the Participant or the Team (or a third person) tries to change the results of summing up by technical, software, or other means during the Contest.

The Organizer is not liable for non-receipt from the Participant or the Team of the necessary information, including through the fault of the postal service, communication providers, technical problems and/or failures of communication channels used during the Contest, and for failure to communicate with the Participant or the Team as a result of incorrect or outdated contact details specified in the registration form on the Website, including sending Prizes to incorrect addresses or contact details, or to an improper addressee due to a mistake made in writing the address by the Participants at registration of their Game account.

The Organizer is entitled to use unclaimed Prizes at its discretion.

The Organizer reserves the right not to enter into any written negotiations or other contacts with the Contest Participants, except in cases specified herein or on the basis of requirements of the existing laws of the Netherlands.

The Organizer is entitled to block access to the Website for the Participant for violation by him or his Team of these Rules in the course of participation in the Contest, or if a Participant or a Team violate these Rules and/or the laws of the Netherlands in any way by their actions/omission to act.

13. The Organizer’s Liabilities:
To conduct the Contest in accordance herewith.

To award a Prize to the Commander of the Winner’s and the Prize Takers’ Teams declared to be the Prizewinners in accordance herewith.

14. Additional Terms:
Participation in the Contest automatically implies the Participant’s acknowledgement of and agreement with these Rules.

Employees of the Organizer and its affiliated persons (employees of affiliated persons), employees of organizations involved in preparation and conducting of the Contest, as well as the families of all the above mentioned persons are not allowed to participate in the Contest.

The Participants shall not act in breach of the rights of third parties and shall comply with the laws of the Netherlands and other applicable laws when applying for participation, as well as at receipt of prizes.

The Contest is not a lottery or another risk-based game.

Payment of cash equivalent value of additional Prizes (if the Prizes are non-monetary in nature) or their substitution with other Prizes is not allowed.

Prizes will not be given out if the Contest Participant fails to comply with these Contest Rules. In case of violation, the Organizer is entitled to dispose of undistributed Prizes in its sole discretion, including giving them out to other Participants.

The Organizer’s decision on all matters relating to this Contest are final and are not subject to revision.

The Organizer reserves the right to place additional information about the Contest.

The Organizer’s responsibility for issuance of Prizes is limited solely by the number of prizes specified herein.

If the prize is returned for the reason “Refused from Receipt”, it cannot be re-claimed by his owner. No claims on uncollected prizes will be accepted.
To fulfill obligations on delivery/handing the prize to the Winner and the Contest Prize Takers, the Organizer is entitled to require from the Winners and the Prize Takers to provide information envisaged and necessary to carry out such actions. Complete or partial refusal of the Winner or the Prize Takers in providing the above mentioned information automatically relieves the Organizer from its obligation to deliver/hand them the Prize.

If, for any reason, any aspect of this Contest cannot be conducted as planned, including the reasons caused by infection by computer viruses, malfunctions in the Internet, defects, manipulation, unauthorized intervention, fraud, technical failures or any cause beyond the control of the Organizer which distorts or affects the performance, security, fairness, integrity or proper conducting of the Contest, the Organizer may, in its sole discretion, cancel, terminate, modify or suspend the Contest.

The Organizer reserves the right to impose at any time additional technical constraints, including those preventing fraudulent driving up the number of voices (if applicable) or submitting by one person of two or more applications to participate in the Contest using different accounts on the website https://sf.mail.ru/.

The Organizer does not distribute Prizes in case of detecting fraud: presenting false cashier’s cheques, fraud at registration on the Website or other violations. The Organizer determines the existence of fraud and falsification in its sole discretion.

Except as expressly provided herein and the provided Prizes, all Contest Participants bear all expenses incurred by them in connection with participation in the Contest (including, but not limited to, the costs associated with Internet access).

In case of a written refusal of the Contest Winner or Prize Taker from receipt of the Prize, the Winner or the Prize Taker loses the right to claim the Prize from the Contest Organizer.

All personal information, including the name, age, the mobile telephone number and/or email address of the Participant will be used solely in connection with this Contest and will not be shared with any third parties for the purposes not connected with the Contest.

The fact of participation in the Contest means that the Participant consents to processing of his personal data, namely, to collection, systematization, accumulation, storage, clarification (update, change), use, blocking, destruction of personal data by the Organizer solely for the purposes of this Contest, in accordance with the requirements of the existing laws of the Netherlands.

All personal data communicated by the Participants for participation in the Contest shall be stored in accordance with the terms of the existing laws of the Netherlands.

The terms used herein refer solely to this Contest.

All disputed issues relating to this Contest shall be subject to regulation on the basis of the current laws of the Netherlands.
